1           Definition of Expressions and Applicability

1.1          Definition of Expressions 

If not defined in a different way, the terms used in the present document have the following meanings:

•      “Convention“

are specified rules that may be applicable on a contract of Carriage, in particular are these:

  • the Convention for the Unification of Certain Rules Relating to International Carriage by Air, signed at Warsaw, October 12, 1929    hereinafter referred to  as “Warsaw Convention”);

  •  the Warsaw Convention as amended at The Hague on September 28, 2019;

  •  the Warsaw Convention as amended by Additional Protocol No. 1 of Montreal (1975)

  •   the Warsaw Convention as amended at the Hague and by Additional Protocol No. 2 of Montreal (1975)

  •   the Warsaw Convention as amended at the Hague and by Additional Protocol No. 4 of Montreal (1975)

  •    the Montreal Convention (1999)

  •    relevant obligatory regulations of the EU, in particular the provisions of the Council 2027/97 regarding the liability of Air Carriers

•        “Airline Code“

is the code of 2 characters or 3 letters that are designated to the particular Airline (2W or WLC = Welcome Air).

•       “Flight Coupon“

is that portion of the Ticket that bears the remark “Flight Coupon“ or “good for passage“, or in the case of an electronic ticket, the electronic coupon; which  indicates the particular places between the coupon entitles you to travel.

•       “Passenger“

is any person, except members of the crew, carried or to be carried in an aircraft, with approval of the Air Carrier.

•       “Fare”

is the remuneration to be paid for the transportation of a passenger for a certain air distance flown.

•       “Stopover“

is a scheduled stop on your journey, at a point between the departure airport and the arrival airport.

•        “Baggage“

is your personal property accompanying you in connection with your trip. Unless otherwise specified, it consists of both your Checked and Unchecked Baggage.

•       “Checked Baggage“

is Baggage that we have taken into custody, and for which we have issued a Baggage Check.

•        “Unchecked Baggage“ (Hand Baggage)

is all other Baggage than Checked Baggage.

•       “Baggage Tag“

is a document issued by us to identify your checked baggage. It consists of a baggage tag that is attached to your Baggage; and a baggage redemption tag given to you.

Ø       “Force Majeure”

are unusual and unforeseeable circumstances beyond our or your control, the consequences of which could not even be avoided if all due care had been exercised.

•       “Itinerary/Receipt“

is a document or documents issued by us, containing the  name of the passenger, flight information and other information.

•       “Air Carrier“

is an air carrier other than ourselves, whose Airline Code appears on your ticket or a conjunction ticket.

•       “Passenger Coupon“

is that portion of the ticket that remains permanently in your possession.

•       “Check-In deadline“

is the time limit specified by us or by an air carrier, by which you must have completed check-in formalities and received your boarding pass.

•       “You“ and “your“ and “youself”

is any person, except members of the crew, carried or to be carried in an aircraft (see also definition of “Passenger”).

•       “Days“

are calendar days including all seven days of the week; provided that, for the purpose of notification, the day upon which notice is dispatched shall not be counted; and provided further that for purposes of determining duration of validity of a ticket, the day upon which the ticket is issued or the flight commenced shall not be counted.

•      “Tariff“

is the remuneration to be paid for the transportation of a passenger including baggage, referring also to the conditions applicable thereto.

•       “Ticket“

is either the document entitled “Passenger Ticket and Baggage Check“, it includes the conditions of contract and notices as well as the flight and passenger coupons.

•       “Agreed Stopping Places“

are those places, with the exception of the place of departure and the place of destination, expressly defined as scheduled stopping places on your route in the ticket or published as such in our timetables.

•       “Conditions of contract“

are the excerpted conditions that are contained in and delivered with your ticket or Itinerary/Receipt, referred to as such and which incorporate by reference these General Conditions of Carriage of Passengers and Baggage as part of your transportation contract.

•       “We“, ”our“, “ourselves” and “us“

denotes Welcome Air Luftfahrt GmbH & Co KG, Gufeltalweg 12, 6026 Innsbruck, Austria. Tel. +43/512/295 296, Fax +43/512/28 88 88.

1.2          Applicability

1.2.1          General

These General Conditions of Carriage apply on any carriage of passengers and baggage including the services rendered by us or our servants. We are authorised to assign the execution of carriage services to third parties/servants, if their safety standard corresponds to those of our airline and the flight is to be operated by an airline of same quality. We can change the flight number unilaterally.

1.2.2          Overriding law

In the event of inconsistency between these General Conditions of Carriage and our tariffs or the applicable law, these tariffs or the applicable law shall prevail over the General Conditions of Carriage.

In the event that any regulation of these General Conditions of Carriage is invalid under the relevant applicable law, the remaining provisions shall be unaffected. 

1.2.3          Charter Flights

These General Conditions of Carriage do also apply if transportation is performed by us pursuant to a charter agreement. If the Charter Agreement provides other provisions, the remaining provisions shall be unaffected and valid.

2           Tickets

2.1          General

1.       We will provide carriage only to the passenger named in the Ticket; you may therefore be required to produce appropriate identification any time (valid passport or identity card).

2.       The Ticket is not transferable. 

3.       The Ticket remains our property. 

4.       Some Tickets are issued at a special Tariff and therefore can not be refunded neither as a whole nor in parts. Therefore we recommend you to see for such case in taking out rescission insurance in order to prevent from any eventual damage. 

5.       If for some reason (Force Majeure) you are not in grade to start off on your trip, we can only credit a not refundable Ticket, if we impose a reasonable administration charge, and if the Ticket is completely unused.  

6.       You will not be entitled for carriage on a flight if your Ticket is incomplete or if it has in any way been altered other than by us or our Authorised Agent.

7.       A Ticket is valuable and you should take all appropriate measures that it is neither damaged nor stolen.  

8.       In case of loss or damage of a Ticket issued by us or one of our Agents upon your request we will replace such a Ticket, provided there is evidence, readily ascertainable at the time, that the ticket for the agreement in question had duly been issued by us or one of our Agents. In such a case you shall sign an agreement to reimburse us for any damage including administrative fees and up to the value of the original Ticket. We or the issuing carrier charges a reasonable administration fee for this service. 

2.2          Period of validity

Our Tickets bought at standard tariff are valid for transportation for one year from the date of issue or, subject to the first travel occurring within one year from the date of issue, one year from the date of first travel under the Ticket. 

A Ticket bought at a tariff other than the standard tariff is valid for transportation only for the period as quoted by the regulations of the air carrier or the transportation tariff or in the Ticket itself. If such provision is missing, a Ticket bought at a tariff other than the standard tariff is valid as most long as a Ticket bought at the standard tariff.

When you are prevented from travelling within the period of validity of the Ticket because at the time you request reservations we are unable to confirm your booking, the validity of your Ticket will be extended until such time as we are able to confirm an adequate seat for which the fare was paid, or you may be entitled to a refund in accordance with Article 9. 

2.3          Coupon sequence and use

The Ticket is valid for transportation as shown on the Ticket, from the place of departure via any Agreed Stopping Places to the final destination.

Should you change your itinerary route without our agreement, we will assess the applicable price for your actual transportation. In this case you will have to pay the difference between the price you have already paid and the price for the new route you have selected. 

In the event that you do not appear on time for a flight you have booked, we may cancel this flight and your onward flights listed in your ticket.

3           Fares, Tariffs, Taxes and Charges

3.1          Ticket prices and fares

Fares apply only for carriage from the departure airport to the destination airport, unless otherwise expressly stated. Fares do not include ground transport between airports and town terminals. The fare will be calculated in accordance with our Tariff in effect on the date of payment of your Ticket for travel on the specified dates and itinerary. Should you change your itinerary or your dates of travel, this may therefore impact the fare to be paid. (extra fare or refund).

3.2          Applicable taxes, fees and charges

Applicable taxes, fees and charges imposed by government, or other authority, or by airport operators shall be payable by you. At the time you purchase your ticket, you will be advised of the taxes, fees and charges not included in the fare, usually shown separately on the Ticket. These taxes, fees and charges imposed on air travel are constantly changing and can be imposed after the date of Ticket issuance. If there is an increase in a tax, fee or charge shown on the Ticket, you will be obliged to pay it. Likewise, if a new tax, fee or charges that you have paid at Ticket issuance are abolished or reduced, you will be entitled to claim a refund. 

3.3          Currency

Ticket fares are to be paid in Euros unless there is another provision due to the Tariff. We may, at our discretion, accept payment in another currency to an appropriate exchange rate.

4           Seat reservations

4.1          No seat reservation 

We are not able to honour reservation of any particular seat for you on board of the aircraft and you agree to accept any seat assigned to you. We reserve the right to assign or reassign seats at any time, even after boarding of the aircraft. This may be necessary for operational, safety- or security reasons. 

4.2          Reconfirmation of Reservations

Onward or return reservations may be required by Air Carriers. If you fail to reconfirm requirement, the Air Carrier may cancel your onward or return reservations.

4.3          Ticket issuance

If you have not paid for the ticket prior to the specified time limit and have made no arrangements with us or one of our Authorised Agents for payment of the Ticket, we may cancel your reservation.   

4.4          Use of personal data

Please note that you have given us your personal data for the purposes of making a reservation for transportation and confirming this reservation to you, providing additional services and facilitating immigration and entry procedures. Moreover your data serve us for accountancy, settlement of accounts, audit, checking of credit cards or other carts of payment, for safety or operational purposes as well as to facilitate further administrative and/or legal transactions with you. For these purposes, you authorize us to retain and use such data, if it is necessary to forward sending and to transmit it to our offices, Authorised Agents, agencies, other Carriers or to the providers of above mentioned services. (for example private security checks).

4.5          Cancellation of Onward Reservations 

If you do not show up for a flight without advising us in advance, we may cancel your onward or return reservation.

5           Check-In and Boarding deadlines 

Check-in deadlines are different at every airport and depend on different factors, as for example the size and organisation of the airport, the amount of passengers, security checks, boarding times etc. Therefore we recommend that you inform yourself of them on time and to comply with the Check-In Deadlines.   In particular we want to refer to the possibility of time-consuming security checks and queues. If you do not comply with the Check-In Deadlines specified by us, we may cancel your reservation. 

5.1          Boarding

We will inform you about the Boarding Deadline during the Check-In procedure. You must be present at the boarding gate not later than the time specified by us when you check in. We may cancel your reservation if you fail to arrive on time at the boarding gate.

5.2          Liability

We do not assume liability for any damage arising from your failure to comply with the provisions of Article 5.

6           Limitation and Refusal of Carriage

6.1          Right to refuse carriage

We may refuse to carry you or your Baggage on our flights if one of the following have occurred, or we have reason to believe it will occur:

a)       such action is necessary in order to comply with any applicable national or international regulations; or

b)       the carriage of you may endanger or affect the safety, health or materially affect the comfort of other passengers or crew; or

c)       you have refused to submit to a security check; or

d)       your physical or mental condition (including impairment by drugs, alcohol or medication) presents a hazard or risk to passengers or crew; or

e)       you have committed misconduct on a previous flight, and we have reason to believe that such conduct may be repeated; or

f)         you have not paid the entire fare including charges, fees, taxes, and fees  charged subsequently; or

g)       you are not in possession of a valid Ticket or the Ticket has been somehow manipulated, damaged, altered  or issued by someone who is not authorised to do so; or

h)       you present a Ticket that has been acquired unlawfully or has been reported stolen and you cannot prove that you are the person named in the Ticket; or

i)          you cannot prove that you are the person named in the Ticket; or

j)         if you fail to observe our instructions with respect to safety and security or other instructions; or

k)       you do not appear to have valid travel documents for departure-, arrival-, transit- and possible alternative destination

6.2          Claims in case of denial of transport 

If a passenger is excluded from carriage due to the points of article 6.1 or if his seat reservation is cancelled for one of these reasons, he does not get any refunding. As for the rest, we are not liable for any damage arising from your failure to comply with one of the provisions of point 6.

6.3          Special assistance

Acceptance of persons with illness, unaccompanied children, pregnant women, incapacitated persons or other people requiring special assistance is subject to express prior arrangement with us.

7           Baggage handling

7.1          Free baggage allowance and excess baggage

You may carry some Baggage free of charge, subject to our conditions and limitations, which are available upon request from us, as well as from the Conditions of Contract printed in the Ticket. 

Acceptance of Baggage in excess of our stated free Baggage allowance is subject to prior arrangement with us. You will be required to pay a charge for carriage of such Baggage. 

7.2          Items Unacceptable as Baggage

You may not include in your baggage:

a)    items which are likely to endanger flight instruments, persons or property on board, in particular those specified in the “Dangerous Goods Regulations“ of ICAO (International Civil Aviation Association) and IATA (International Air Transport Association). Further information is available from  our reservation office upon request

b)    items the carriage of which is prohibited by the applicable national or international law of the state of departure, or of the state that is being flown to or over

c)    items, which are considered by us to be unsuitable for carriage because they are dangerous, unsafe or by reason of their weight, size, shape, or character, or because of being fragile, perishable or which for other reasons are unsuited for transport as Baggage

d)    items not or not properly packed in our view. Further information about the properly package materials and methods is available from our reservation office

e)    Firearms or ammunition other than for sporting purposes are subject to the “Dangerous Goods Regulations“ which in essence say that firearms and ammunition for sporting purposes may accepted as Checked Baggage if they are unloaded with the safety catch on and suitable packed. Under no circumstances carriage of such items is allowed in Unchecked Baggage.  

f)      You must not include in Checked Baggage money, jewellery, valuables, precious metals, computers, expensive or sensitive electronic or optic devices, medication, keys, negotiable papers, securities or other valuables, documents, passports, identification documents, samples or other objects of particular value. We expressly state that we shall not be held liable for any loss or damage to such items.   

7.3          The right to refuse carriage

We reserve the right to refuse carriage of items referred to in Article 6.3 any time, also during transportation.

Due to operational or safety reasons we can postpone the carriage of Baggage to a later flight. We do not assume liability for damages arisen from a belated carriage of Baggage.  Usually we try to transport your Baggage together with you in the same aircraft.

7.4          Right of Search 

Under international law a search of Passengers or Baggage may be ordered. If you are unwilling to comply with any search request in order to check whether your person and/or your Baggage contains any item described in the Articles mentioned above, we may refuse to carry you or your Baggage. If you are not available, your Baggage may be researched in your absence. 

7.5          Checked Baggage 

Upon delivery to us of the Baggage you wish to check, we will take it into our custody, and issue a Baggage Tag for each piece of your Checked Baggage. 

Checked Baggage must have your name or other personal identification affixed to it. 

7.6          Hand Baggage – Unchecked Baggage 

The maximum dimensions and weight for Unchecked Baggage are specified in the Ticket, further information is available from our reservation office upon request. Furthermore your Unchecked Baggage must fit under a seat or in an Baggage compartment, other wise it must be checked. 

Objects not suitable for carriage in the hold (such as delicate musical instruments) will only be accepted for carriage in the cabin, if you have given us notice and permission has been granted by us.

7.7          Excess Baggage

We will request you to pay a separate charge of Euro 2,- per kilo (subject to change) for this service.

7.8          Collection and Delivery of Checked Baggage

a)       You are required to collect your Checked Baggage as soon as it is made available at your destination or Stopover. Should you not collect it within a reasonable time, we may storage your Baggage and charge a storage fee.  

b)       We deliver the Checked Baggage to the bearer of the Baggage. We are however not responsible for checking that the bearer of the Baggage Check is the rightful recipient of the baggage to be delivered. We are not liable for losses, damages or inconvenience resulting from our failure to check whether the bearer of the Baggage check is also the rightful recipient. The baggage will be delivered at the destination indicated in the Baggage Check.

c)       If a person claiming Checked Baggage is unable to produce the Baggage Check and identify the Baggage by means of the identification portion of the Baggage Check (if such has been issued), we will deliver Baggage to such person only on the condition that we are satisfied that this is the rightful owner of the baggage.

d)       If the owner of the Baggage Check collects the Baggage at delivery without written objection, it is assumed, until proving the opposite that the baggage has been delivered in good conditions and confirm to the contract of carriage.

7.9          Animals

a)       As far as the transport of animals is concerned, you are asked to always contact our reservation office.

b)       The transport of dogs, cats, domesticated birds and other domestic animals is subject to the approval of the Air Carrier. Such approval provides that the animals are properly crated in containers and accompanied by valid health- and vaccination certificates, entry permits and other documents requested by   countries of entry or transit. The Air Carrier reserves the right to specify how the animals are to be transported and to limit the number of animals admissible on a flight.

c)       If accepted as Baggage, the animal, together with its container and food, shall not be included in your free Baggage allowance, but shall constitute excess baggage, for which you will be obliged to pay the applicable rate for excess Baggage mentioned above.

d)       Guide dogs and their containers will be carried free of charge over and above the free baggage allowance.

e)       Prerequisite for the allowance of carriage of small domestic animals or guide dogs is that the passenger assumes full responsibility for the animal. The Air Carrier will have no liability for injury, death or the loss, delay or sickness of the animal, nor that the entry in or the transit through the relative countries is permitted, unless we have caused the damage deliberately or through gross negligence.

8           Schedules, Cancellation of flights and Delays 

8.1          Schedules

The flight times shown in timetables may change between the date of publication and the date you actually travel. We can therefore not guarantee them to you and they do not form part of your contract with us.

Before we accept your booking, we will inform you of the scheduled flight times in effect as of that time; and it will be shown on your Ticket. It is possible that we may need to change the scheduled flight time subsequent to issuance of your Ticket. If you provide us with contact information, telephone number or email address, we will inform you of such changes. If, after you purchase your ticket, we make significant changes to our flight times that are unacceptable to you and we are unable to offer you a flight that is acceptable to you, you will be entitled to a refund of the Ticket.

8.2          Cancellation, Rerouting, Delays 

We have a high rate of reliability and punctuality and we continue to make great efforts in order to avoid delays in future, too. For this purpose and in order to prevent cancellation of a flight, in exceptional circumstances we may arrange for a flight to be operated on our behalf by an alternative carrier or aircraft.

Except as otherwise provided by the Convention, if we fail to operate a flight according to schedule, fail to stop at your final destination or Stopover destination for what reason ever, we shall, at your option, either:

a)       carry you on the next of our scheduled services on which space is available without additional charge and, where necessary, extend the validity of your Ticket, or

b)       offer you a refund in accordance with the provisions of the these Conditions of Carriage

These options are the sole remedies available to you in these cases; we do not assume liability for damages financial losses

If we are unable to provide you space on the flight, despite a confirmed reservation and your punctual arrival, we shall provide compensation in accordance with the Council Regulation (EEC) 295/91 (establishing common rules for a denied-boarding compensation system in scheduled air transport, in the relevant current version).

9           Refunds

9.1          To whom refund made

We shall be entitled to make a refund either to the person named in the Ticket or to the person who paid for the Ticket. If the Ticket was paid by a person another than the Passenger named in the Ticket, and the Ticket indicates that there is a restriction on the refund, we shall make a refund only to the person who paid for the Ticket.

Refunds will only be made on surrender to us of the Ticket and all unused Flight Coupons.

9.2          Loss of the Ticket 

If you lose a Ticket or a portion of it, upon furnishing us with satisfactory proof of the loss, and payment of a reasonable administration charge, refund on the Ticket will be made after expiry of the validity period of the Ticket, on condition:

a)       that the lost Ticket, or portion of it, has not been used, previously refunded or replaced

b)       that the person to whom the refund is made undertakes, in such form as may be prescribed by us, to repay to us the amount refunded in the event of fraud and/or to the extent that the lost Ticket or portion of it used.If we or one of our Authorised Agents lose the Ticket we shall replace it.

9.3          Currency

All refunds are subject to national laws, regulations and instructions of the country where the Ticket was originally bought and of the country where the refund is made.

Subject to the provision mentioned above, refunds are usually made in the currency used to pay for the Ticket. If we refund a Ticket in Euros to the rate of exchange in use on the date of payment, this is, in our opinion, a release of guilty.


9.4          Involuntary Refunds

You are entitled to a refund of the entire price of the Ticket or for those portions of it that have not been used, if

a)       we cancel a flight or fail to operate a flight

b)       we fail to operate a flight according to schedule, or operate a flight very delayed and you will not take the flight therefore

c)       If we do not carry you to the f destination by other means of transport if the aircraft will not land at the destination

10        Conduct On Board the Aircraft

10.1       General

You shall conduct on board of the aircraft such that:

·         the aircraft, or any person or property on board, are not endangered

·         you do not obstruct the crew in the performance of their duties, or fail to comply with their instructions, including but not limited to those with respect to smoking, alcohol or drug consumption, or

·         you do not behave in a manner which causes or is likely to cause discomfort, inconvenience, damage or injury to other passengers or the crew.  We may take such measures we deem necessary to prevent continuation of such conduct, including restraint. In such cases you may be disembarked and refused onward carriage at any point, and may be prosecuted for offences committed on board the aircraft.

10.2       Electronic Devices

For safety reasons, the operation of electronic equipment such as mobile telephones,  laptop computers, portable radios and recorders, CD players, electronic games or transmitting devices, including radio controlled toys and walkie-talkies is forbidden. The use of hearing aids and pacemakers is permitted.

10.3       Food brought on board

We reserve the right to prohibit consume of drinks and food brought on board if necessary.

11        Additional services

We act as your agent if we make arrangements for you with a third party to provide any services other than carriage by air (hotel reservation, connecting carriage, car rental etc.)

If these ancillary services are rendered by ourselves, we shall be liable only for intent and gross negligence.

12        Travel documents and travel formalities

12.1       Travel documents

You are responsible for obtaining and safekeeping of all required exit, entry, transit documents, visas, health documents or other necessary documents. You permit us to make and retain copies thereof. 

We may deny carriage if your travel documents do not appear to be in order and unsuitable for entry, exit in or transit through a country.  We can deny carriage to passengers who do not present a valid passport or identity card. A driving license will not be accepted as valid travel document.

You are responsible for complying with all laws and regulations of countries to be flown from, into or through which you transit.

12.2       Refusal of entry

If you are denied entry into any country, you will be required to pay any resulting fine, charges levied against us, increase of administrative duties etc.  If we are required to pay any amount or expenditure incurred for you, you shall reimburse the cost. The cost for the Ticket will not be refunded by us.  We will not bear the cost of transporting you from that country. You shall reimburse us for any cost arisen from a refusal of entry.

12.3       Customs inspection

If required, you shall attend and supervise inspection by customs or other government officials, which is upon your responsibility.  We do not assume any liability in this context.

12.4       Exclusion of Liability

We do not assume any liability for damages arising from your failure to comply with one of the provisions of this Article 12. 


13        Amendments and waiver

None of our Authorised Agents, employees, or authorised representatives is entitled to supplement or amend these General Terms and Conditions of Carriage.


14        Court of Jurisdiction and law

If there are no other prevailing provisions, Austrian law is applicable. The applicable court of jurisdiction is Innsbruck.
